Brazos County declines assault charges against trooper in South Carolina football incident



The Brazos County Attorney's Office will not pursue criminal assault charges against a Texas Department of Public Safety trooper who was seen shoving his way through two South Carolina football players during a November game, according to the attorney representing one of the players.

Keith Jackson, who represents South Carolina player Oscar Adaway, said Monday he was told the county attorney's office would not pursue charges "in an effort to protect and not embarrass" the trooper. Jackson said there is no other avenue to pursue at this point.

The incident occurred Nov. 15 during South Carolina's game against Texas A&M at Kyle Field in College Station. Video captured on national television showed the trooper appearing to elbow his way through Adaway and teammate Nyck Harbor after a touchdown. The trooper was relieved of his gameday duties following the incident.

Jackson filed a criminal complaint with the Texas A&M University Police Department on Dec. 12. He said the complaint was filed in part to uncover the trooper's identity so that further criminal charges could be filed.

Attorney vows to leave no stone unturned after charges declined against DPS trooper

BRAZOS COUNTY, Texas — Attorney Keith Jackson is pressing for accountability after Brazos County Attorney Earl Gray declined to pursue charges against a Texas Department of Public Safety trooper involved in an incident with South Carolina football players.

The complaint, filed by Jackson on Dec. 12 on behalf of player Oscar Adaway, was looking for assault charges against the trooper captured on video pushing through the players after a touchdown by Gamecocks wide receiver Nyck Harbor in College Station last month.

Jackson expressed frustration over the decision, stating, "They chose not to pursue the case. And that was literally the sentence in the email that we received. I will not be pursuing a criminal charge in this matter." He questioned the reasoning behind the decision, asking, "What was the calculus, the thought behind not pursuing what appeared to be an obvious unwanted touching of my client, which is the prima facie definition of an assault."

CBS Austin obtained a copy of the email sent from Gray's office to Jackson, It states, "The Texas A&M University Police Department has completed a thorough investigation of the case. I will not be pursuing criminal charges in the case."

The Texas A&M University Police Department has not identified the trooper who allegedly assaulted the football player. Therefore, a civil lawsuit cannot be filed.
