SACRAMENTO, California Californias near-total ban on openly carrying firearms in public is unconstitutional, a panel of federal judges ruled on Friday. The Ninth Circuit Court of Appeals struck down a portion of Californias gun licensing laws that prohibits authorities from issuing permits to openly carry guns in counties with more than 200,000 people covering Californias major population centers.
The judges ruled 2-1 that the policy is inconsistent with the 2022 firearm access standards set by the Supreme Courts New York State Rifle and Pistol Association v. Bruen decision. That ruling stated gun laws should prioritize historical Second Amendment rights over public safety issues.
The appellate panel is made up of two Donald Trump appointees, Lawrence VanDyke and Kenneth Lee, and one selected by George W. Bush, N. Randy Smith. VanDyke wrote the ruling, with Lee concurring and Smith partially dissenting and concurring.
Under Bruen, this is a straightforward case, VanDyke wrote. California is attempting to address a general societal problem through materially different means than were used during either the Founding or Reconstruction.

(3,825 posts)But the sinister 6 don't care for original meanings ...well regulated ...or the real history of guns in cities.

(24 posts)Indeed. The gunfight at the OK Corral was ignited over a failure to check guns, although there were other problems leading up to it.
The Supreme Court's position is ahistorical. MUCH IS REQUIRED goes into detail about it--https://www.marvindjones.blogspot.com/2013/08/much-is-required.html

(17,636 posts)even if we took over the Congress and the Presidency, it still wouldn't happen.
For that to happen, you would need 2/3rds of the Congress and 3/4ths of the states to ratify any change to the BoR, think there's the votes for that?

(40,363 posts)I must say that openly carrying a gun in my city is an invitation for others to shoot or disarm you. Could be the cops, could be a fourteen year old gang member.
Either way, it's gonna be humiliating.
