A Massachusetts judge on Friday ordered the Trump administration to republish medical research papers removed from a government website for using words like LGBTQ and transgender.
On March 12, two Harvard Medical School doctors filed a 29-page lawsuit over the removal of private doctors peer-reviewed articles from Patient Safety Network (PSNet), an online database where doctors and researchers provides articles, tools, and resources to facilitate future research efforts, influence hospital policies, and educate providers and patients about patient safety best practice.
In April, the plaintiffs moved for a preliminary injunction where the government need only republish the censored content. Now, U.S. District Judge Leo T. Sorokin, a Barack Obama appointee, has granted that requested relief in a 28-page order. The plaintiffs are likely to succeed in proving that the removal of their articles was a textbook example of viewpoint discrimination by the defendants in violation of the First Amendment, the judge wrote.
The Trump administration by way of the obscure Agency for Healthcare Research and Quality (AHRQ) which was itself acting on guidance issued by the Office of Personnel Management (OPM) explicitly removed the articles in question because of the verboten words. The OPM guidance was issued to effectuate the Jan. 20, executive order issued by President Donald Trump directing administrative agencies to remove all statements, policies, regulations, forms, communications, or other internal and external messages that promote or otherwise inculcate gender ideology.
