Chief Justice Roberts temporarily halts discovery in DOGE case

Chief Justice Roberts temporarily halts discovery in DOGE case
https://thehill.com/regulation/court-battles/5316683-supreme-court-halts-discovery-lawsuit/

Chief Justice John Roberts temporarily halted discovery Friday in a lawsuit seeking access to documents and information about the Department of Government Efficiency’s (DOGE) operations.

In a brief order, Roberts granted the government’s request for an administrative stay, which temporarily lifts a judge’s order allowing limited discovery into whether DOGE is an “agency.” If it is found to be an agency, that would make DOGE subject to Freedom of Information Act (FOIA) requests.

The request went to Roberts by default; he handles emergency appeals arising from the nation’s capital. The pause will last until the court decides whether to wipe two lower court rulings letting discovery move forward, which Roberts could himself decide or refer to the full court.

Interesting way to dodge the law. We'll see.

We shudda had Trump in jail on Jan. 21, 2021. Yet, lots of noise, but zero action.

And two years later and we blame two crypto-puke Ds from AZ and AR.

Roberts gave it to him.

Roberts is in step with the Fascist Party. Not a practicing Fascist, but Fascist-leaning. Just as he's not a practicing racist, but definitely racist-leaning

He will be the one final nail in the coffin of American Democracy.

Delay, delay, delay until it goes away. And when the shriveled orange penis appears, Roberts will gladly indulge.

This is how I think of Roberts. While we go berserk about the in-your-face judicial outrages committed by Thomas and Alito we miss that the true and lasting damage has all been at Roberts’ hand. Citizen’s United was all by itself a death blow to participatory democracy. It did so many terrible things in one decision that is almost tedious to list them all. Legalization of political bribery. The opening up of election funding to unnamed, dark sources that could be and often are foreign sources (think Russia, Russia, Russia and also China, China, China); conflating the donation of money with speech which eliminates any concept of one man one vote); effectively bestowing citizenship on corporations…

The other death blows became almost after thoughts after Citizens. Gutting the Voting Rights Act, declaring gerrymandering non-justiciable, Dobbs (if you think Roberts didn’t play a major role you’ve lost the bubble), the granting of some sort of made up non-Constitutional immunity to the chief executive, denying that Trump’s insurrection didn’t automatically invoke the 14th amendment… It is all too much and it happened in plain view.

I’ve found myself marveling at the ruthlessness,’the precision strike against the fundamental pillars of American representative democracy, and the smirking arrogance of John Roberts.

He was birthed in the stinking bowels of the Federalist Society and he has been their most effective weapon by far. What Roberts has done simply dwarfs anything Roger Taney did in the Dred Scott decision. That one decision ultimately meant a bloody protracted civil was. But what the Genial Assassin has done most likely means an end to even our attenuated version of democracy and the ushering in of a right wing dictatorship and the elimination of any sort of law that could garner any respect or admiration.

And he is doing it all with a simpering, bobble headed smile on his face. It is so easy to focus on the scowling faces of Alito and Thomas. But while we are distracted the Honorable Justice John Roberts is gutting our entire system of justice.

That would seem to make them an agency, which should be illegal because it is Congress that has the authority to create an agency, not the president. Regular citizens who are not employees of the government, which means vetting and security checks and clearances for many employees, are not allowed to fire people, cancel government contracts, and shut down agencies.

The initial request for a stay pending appeal filed by DOGE was directed to Roberts as the Justice responsible for handling such requests arising out of the US District Court for the District of Columbia. If Roberts had denied it, DOGE could have renewed its request in front of any Justice it chose -- including Thomas or Alito. And they might have issued a more sweeping stay than the one issued by Roberts. So as is often the case, the stay issued by Roberts may be a defensive maneuver to keep control of the matter rather than leave it the hands of a Justice chosen by DOGE.
